Tony LaRussa,a manager in Major League Baseball, currently with the St. Louis Cardinals, sued Twitter for eight causes of action.
It seems like someone has created an account in his name .The count contains picture of LaRussa and some many vulgar updates. Therefore,he sued Twitter for trademark infringement, false designation of origin, trademark dilution, cybersquatting and some other four.
In the complaint it is written: "Defendant's use of Plaintiff's mark both in the site's domain name and on the site itself is misleading and likely to confuse users by leading them to to believe that this site is endorsed and authored by Plaintiff LaRussa. The site states in large lettering "Tony LaRussa is using Twitter",and encourages users to "Join today to start receiving Tony LaRussa's updates.""And then "Defendant's use of Plaintiff's famous mark in commerce ,which began after Plaintiff's mark was already famous, creates a likelihood of dilution of the mark's distinctive value by diminishing the capacity of the mark to identify and distinguish Plaintiff's goods services".
Indeed,an interesting case.We can only wait and see what is going to happen next.
