It seems that over the years OHIM has received three application to register Tarzan's yale as a trademark .
The first one was received in February,2004,but OHIM refused the application,the examiners believed that Tarzan's yale was not clear,precise,objective and concise. The second one was received by OHIM also in February,2004 and it was accepted. The third one,and the last one until now,was filed in May 2006 .The sound combines a sonogram with an MP3 sound file.For now,the examiners haven't yet made a decision. "We are getting increasing interest in this area-everything from Tarzan's call to a lion's roar.If they comply with the formalities and are distinctive they can be registered,and we now accept MP3 files as part of this process,provided they are filed together with the sonogram.As technology moves on we haved moved too.",said Wouter Verburg,one of OHIM's trade mark lawyers .
